Copyright in the Academic Environment

Part I: Understanding Copyright as Rights Holders

The purpose of this module is to familiarize you with basic copyright concepts, including

  • Copyright eligibility criteria
  • Exclusive rights to protected works
  • Term of copyright protection.

Proficiency with copyright fundamentals lays the foundation for understanding exceptions to copyright protection for teaching and scholarship under Fair Use and the TEACH Act, and for accessibility under the Chaffee amendment -- the subjects of modules II and III.

Copyright in the Academic Environment

Part II: Limits on Exclusive Rights: Fair Use and TEACH Act

In Part I, Understanding Copyright as Rights Holders, we introduced the exclusive rights that creators have to our copyright-eligible works.

The purpose of Part II is to equip you to make reasoned, good faith determinations regarding the use of other creators' copyright-protected works, including

  • Determining a work's protected status
  • Evaluating the Four Factors to make a Fair Use determination
  • Understanding your rights and responsibilities as an online instructor under the TEACH Act
  • Knowing when and how to obtain permission
  • Using library resources and services to locate alternative content.

We will develop an appreciation for "copyright’s built-in free speech safeguards"* and the direct relationship between copyright law and the public benefit of free expression codified in the First Amendment.

Part III: Copyright and Accessibility: Chafee Amendment, ADA and Section 504

The purpose of Part III is to comment on using copyright-protected works for purposes of accessibility.

We will discuss how to meet our obligations to students under the Americans with Disabilities Act (1990) and Section 504 of the Rehabilitation Act (1973) in light of the Chafee Amendment to copyright law.
